Anıl Emre is our partner in charge of transactions (cross-border and local) and international legal affairs. Mr. Emre is a leading practitioner in international EPC contracts and regularly advises market-leading Turkish companies in their projects around the world. Mr. Emre also advises local and foreign clients regarding the resolution of complex transactional disputes. Prior to joining Emre Legal, Anıl Emre was senior legal counsel at Enka Insaat ve Sanayi AS, one of the largest Turkish EPC contractors worldwide, handling cross-border contracts and international arbitration.

Mr. Emre has wide experience in drafting and negotiating EPC contracts directly with general counsels and leading executives of the largest energy/infrastructure companies in the world as well as concession agreements (Build-Operate, Build-Operate-Transfer basis) with ministers and high-level representatives of various governments.

Mr. Emre acts for both the employers and the contractors and provides services covering the whole lifespan of a project; starting from reviewing and commenting on the project documentation at pre-bid phase; drafting and negotiating JV/consortium/shareholders agreements with joint-bidders, and negotiating the prime EPC/project documentation with the employer.

Mr. Emre also regularly advises investors, landowners and contractors in connection with large-scale residential, office space and mixed use property developments in Turkey and represents his clients in disputes in connection with construction/real-estate projects.

Highlights from Mr. Emre’s practice includes:

  • drafting and negotiating a variety of EPC and construction contracts for a diversified portfolio of projects including a variety of power plants encompassing CCPPs, SCPPs, OCPPs, HPPs, cruise ports and terminals, vessel ports, railroad projects, pipelines and high-tech medical facilities throughout different regions and countries encompassing Western Europe, the Caucasus, Russia, Latin America and Turkey; with a particular focus on the FIDIC suite of contracts

  • drafting and negotiating concession/investment agreements with sovereigns for PPP projects (worked on the succesful negotiations for a major hydropower concession with the Ministry of Economy of Georgia (awarded on a BOO basis), worked on several other investment agreements in regions encompassing the Caucausus, East Africa and Latin America

  • drafting and negotiating shareholders’ agreements, joint venture agreements, consortium agreements, partnership agreements, cooperation agreements, MOUs as well as other project documentation for a wide range of projects

  • overseeing several international arbitration proceedings as client lead counsel; including:

    • ICC administered arbitration involving a dispute with an African state (Geneva seat, French law), as well as litigation for recognition and enforcement of the award in the US and various European countries

    • ICC administered arbitration involving a dispute with a Caucasian state in connection with a Build-Own-Operate Agreement (Paris seat, host country law)

  • working on sector specific commercial transactions, including but not limited to acquisition/sale/chartering of aircrafts and a variety of hotel management/franchise agreements

  • representing the regional franchisee of a top global FMCG company in connection with the amendment of their long-standing franchise agreement

  • representing a Turkish mining conglomerate in their negotiations with a Chinese state-owned entity in connection with cross-border sales of zinc and iron ore

  • representing a media client in connection with the global distribution agreement regarding their wide ranging portfolio of music/video assets

  • acting for the investors in connection with their investment in a California-based EV start-up
